Ahead of December 4 arguments in a Supreme Court case (U.S. v. Skrmetti) challenging the constitutionality of Tennessee restrictions for gender affirming care for minors, KFF explores the background of the case and potential rulings. Twenty-six states have enacted laws restricting youth access to gender affirming care, most of which are facing legal challenges. This is the first time the Supreme Court is considering the constitutionality of such state restrictions, and the Court’s decision could impact access to this care nationwide.
